Notice of the resolution to adopt the 45th amendment to the Land-Use Plan (as amended by the 2005 re-publication) of the Neuenhaus Joint Municipality, and the early public consultation in accordance with Section 3(1) of the Building Code (BauGB).
At its meetings on 11 June 2025 and 8 July 2026, the Joint Municipal Committee of the Neuenhaus Joint Municipality adopted the resolution to draw up the 45th amendment to the Land-Use Plan (as amended by the 2005 re-publication) and resolved to initiate early public participation in accordance with Section 3(1) of the BauGB and the participation of bodies representing public interests in accordance with Section 4(1) of the BauGB.
The resolution to put the plan on public display is hereby published in accordance with Section 2(1) of the BauGB.
The reason for the 45th amendment to the land-use plan is the extension of the ‘other special area’ designated for use as a ‘wind farm’ (29th amendment to the Georgsdorf Wind Farm Land-Use Plan), with a view to increasing the share of renewable energy. The amendment to the Land Use Plan is intended to create the planning law requirements for the further use of suitable land for wind energy. This area has previously been designated as agricultural land and is to be re-designated as an ‘other special area’ with the designated use ‘wind farm’ (SO Wind). In accordance with Section 249c of the German Building Code (BauGB), wind energy areas shown in the land-use plan must also be designated as acceleration zones (BG) for onshore wind energy. The planning of the special area is to be carried out in accordance with the ‘rotor-out’ principle. The exact boundaries of the area covered by the amendment are set out in the scope of application below.
Early public notification in accordance with Section 3(1) of the BauGB regarding the aims and objectives of the planning process, etc., is provided by making the planning documents available online at www.neuenhaus.de under the heading ‘Building and Environment/Urban Land-Use Planning/Current Planning Procedures from 21 September 2026 to 21 October 20226 (inclusive). In addition, the planning documents will be available for inspection during office hours at the citizens’ office of Neuenhaus Joint Municipal Authority, Veldhausener Str. 26, 49828 Neuenhaus. During this period, there will be a general opportunity to submit comments and engage in discussion. Furthermore, comments may also be submitted by post (see address above) or by email (rathaus@neuenhaus.de).
As part of the preparation of the local development plan, an environmental assessment is carried out in accordance with Section 2(4) of the BauGB. The environmental impacts are described and assessed in an environmental report. Early public participation serves to provide information and to identify issues of significance for further planning. The comments received will be examined and, insofar as they are relevant to the planning process, taken into account in the subsequent stages of the process.
At a later date, the draft plans, together with the accompanying explanatory notes and further documentation, will be made available for public inspection once again. During this public inspection period, there will be a further opportunity to submit comments on the content of the plans.
