Joint announcement by the Neuenhaus Joint Municipal Authority and the Town of Neuenhaus
32nd amendment to the land use plan
By order dated 10 June 2026 , the district of Grafschaft Bentheim approved the 32nd amendment to the Neuenhaus Joint Municipality Land Use Plan (as amended by the 2005 re-publication) in accordance with Section 6(1) of the Building Code (BauGB). The granting of this approval is hereby announced in accordance with Section 6(5) of the Building Code (BauGB).
Zoning Plan No. 82.1 ‘An der Landstraße, Extension’ for the town of Neuenhaus
At its meeting on 25 February 2026, the Neuenhaus Town Council adopted Development Plan No. 82.1 ‘An der Landstraße, Extension’ as a by-law in accordance with Section 10(1) of the BauGB. The aforementioned development plan will create further commercial sites, the majority of which will be transferred to a local business that has hitherto been based within the town centre of Neuenhaus.
The scope of this plan amendment covers plots 27/22, 27/20, 27/21 in cadastral district 13 of the Neuenhaus municipal area, situated in the area south of ‘Gerhard-Jeurink-Straße’ and west of ‘Fasanenweg’.
The aforementioned urban development plans, together with the explanatory notes, may be inspected by any member of the public at the Building Authority of the Neuenhaus Joint Municipality, Veldhausener Straße 26, 49828 Neuenhaus, during office hours, in accordance with Section 10(3), second sentence, of the BauGB. Information regarding their content will be provided on request. Upon publication, the amended land-use plan shall take effect in accordance with section 6(5) of the German Building Code (BauGB). Furthermore, the aforementioned development plan shall enter into force in accordance with section 10(3), fourth sentence, of the German Building Code (BauGB).
Reference is made to the provisions of Section 44 (3) sentences 1 and 2 and (4) BauGB regarding the timely assertion of any compensation claims for the financial disadvantages specified in Sections 39 - 42 BauGB and the expiry of compensation claims.
Pursuant to Section 215 (1) BauGB, they are irrelevant:
- a violation of the procedural and formal requirements specified in Section 214 (1) sentence 1 numbers 1 to 3,
- a violation of the provisions on the relationship between the development plan and the land-use plan, taking into account Section 214 (2), and
- any deficiencies in the weighing-up process pursuant to Section 214 (3) sentence 2,
unless they have been raised in writing with the Neuenhaus Joint Municipal Authority, Veldhausener Straße 26, 49828 Neuenhaus, within one year of the notice being issued, setting out the facts giving rise to the infringement.
