Notice from the Town of Neuenhaus
At its meeting on 28 May 2026, Neuenhaus Town Council adopted the development plan set out below as a by-law in accordance with Section 10 of the Building Code (BauGB), as currently in force, and approved the explanatory statement.
Local Development Plan No. 64 ‘Hilten’ – 7th Amendment
The amendment to the local development plan will create a further area suitable for the development of small-scale housing.
The scope of this plan amendment covers plot 167 and part of plot 76/2 in cadastral district 40 of the Neuenhaus municipal area, situated on Buitenborg Street, at the former Mons farmstead, number 19.
The above-mentioned development plan, together with the explanatory statement, may be inspected by any member of the public at the Building Authority of the Neuenhaus Joint Municipal Authority, Veldhausener Straße 26, 49828 Neuenhaus, during office hours, in accordance with Section 10(3), second sentence, of the German Building Code (BauGB). The above-mentioned development plan shall come into force on the date of its publication, in accordance with
Section 10(3), fourth sentence, of the BauGB is in force.
Reference is made to the provisions of Section 44 (3) sentences 1 and 2 and (4) BauGB regarding the timely assertion of any compensation claims for the financial disadvantages specified in Sections 39 - 42 BauGB and the expiry of compensation claims.
Pursuant to Section 215 (1) BauGB, they are irrelevant:
1. a material breach of the procedural and formal requirements specified in section 214(1), first sentence, points 1 to 3 of the BauGB,
2. a violation of the provisions on the relationship between the development plan and the land use plan that is notable under Section 214 (2) BauGB and
3. any deficiencies in the weighing-up process pursuant to Section 214 (3) sentence 2 BauGB,
unless they have been raised with the Town of Neuenhaus, Veldhausener Str. 26, 49828 Neuenhaus, within one year of this notice, setting out the facts giving rise to the infringement.
