Announcement of the municipality of Osterwald
At its meeting on 1 July 2025, the council of the municipality of Osterwald adopted the 1st amendment to development plan no. 14 "Nördlich Industriestraße" in accordance with Section 10 of the German Building Code (BauGB) as amended. version and approved the explanatory statement
The subject of the amendment is the amendment of Section 1d of the textual provisions of the development plan to the effect that the sale of electrical household appliances and electronic products is now possible in the plan area.
The area of application covers the entire area of the aforementioned development plan. This affects parcels 1/23, 1/29, 1/30, 1/31, 1/32, 268/2, 1/33, 3/269, 4/153 and parts of 4/152 and 269/5 of parcel 7 of the Osterwald district, all located on the corner of Industriestrasse and Georgsdorfer Strasse in Osterwald.
In accordance with Section 10 (3) sentence 2 (BauGB), the development plan and the explanatory statement can be inspected by anyone at the building office of the Neuenhaus joint municipality, Veldhausener Straße 26, 49828 Neuenhaus during office hours and at the municipality of Osterwald, Bimolter Straße 60, 49828 Osterwald (by prior arrangement telephone no.: 05941/5512). Information on the content will be provided on request. The plans can also be viewed at www.neuenhaus.de under the heading Bürger*innen/Bauen, Ordnung, Verkehr/Bauleitplanung/Rechtskräftige Bauleitplanung/Gemeinde Osterwald.
The above-mentioned development plan comes into force on the day of the announcement in accordance with Section 10 (3) sentence 4 BauGB.
Reference is made to the provisions of Section 44 (3) sentences 1 and 2 and (4) BauGB regarding the timely assertion of any compensation claims for the financial disadvantages specified in Sections 39 - 42 (BauGB) and the expiry of compensation claims.
Pursuant to Section 215 (1) (BauGB) are irrelevant:
1. a breach of the procedural and formal requirements specified in Section 214 (1) sentence 1 nos. 1 to 3 BauGB,
2. a violation of the provisions on the relationship between the development plan and the land use plan that is notable under Section 214 (2) BauGB and
3. any deficiencies in the weighing-up process pursuant to Section 214 (3) sentence 2 BauGB,
if they have not been asserted against the municipality of Osterwald, Bimolter Straße 60, 49828 Osterwald within one year of this announcement, stating the facts justifying the violation.
