Urban land-use planning

At its meeting on 14 May 2025, the joint municipal committee of the Neuenhaus joint municipality approved the draft for the 41st amendment to the land use plan and agreed to its public presentation. The amendment to the land use plan is intended to designate land in the Alte Piccardie area of the municipality of Osterwald as a "wind energy" special area.

The following environmental information is available for the urban land-use planning:

  • Environmental report in accordance with Section 2a of the German Building Code (BauGB) on the 41st amendment to the land use plan
    • Inventory and assessment of environmental protection issues, including nature conservation and landscape management, in particular:
      • the environmental impact on humans, human health and emissions
      • the impact on animals and plants, biodiversity, species and protected areas and objects
      • the impact on land, soil, water, climate and air
      • the impact on the landscape
      • the impact on cultural and other material assets
      • Species protection
      • Statements on the European network - Natura 2000
      • the interactions between the individual aspects of environmental protection
      • Vulnerability to major accidents and disasters
    • Impact forecast and environmentally relevant measures
    • Additional information with a description of the planned measures for monitoring the significant environmental impacts
    • Final assessment and procedure
  • Species protection contribution to the 41st amendment to the land use plan
  • Preliminary assessment of the fauna-flora habitat (FFH) for the 41st amendment to the land use plan for the FFH areas "Dalum-Wietmarscher Moor" and "Georgsdorfer Moor"
  • Biotope type map and biotope type mapping 2022, description of the biotope types for the 41st amendment to the land use plan
  • Restriction check
  • Results report on breeding birds and standard land use analysis 2020 for the 41st amendment to the land use plan
  • Survey of migratory and resting birds, survey results 2020 - 2022 for the 41st amendment to the land use plan
  • Preliminary landscape assessment for the 41st amendment to the land use plan
  • Comments from authorities and other public agencies from the participation procedure in accordance with Section 4 (1) BauGB (from 29/08/2014 to 30/09/2014) from the participation procedure in accordance with Section 3.1 BauGB (early public participation) including proposals for consideration)
    • Opinion of the county of Grafschaft Bentheim:
      • Basic requirements for the environmental report
      • Statements on the consideration of the important meadow bird area "Alte Piccardie" in the environmental report, the habitat areas for breeding birds, the backdrop of the meadow bird protection programme of the NLWKN (Nds. Weg) and the wet meadow programme of the district of Grafschaft Bentheim, strictly protected meadow bird species in the meadow bird area "Alte Piccardie", Lower Saxony-wide importance of the meadow bird area, resulting very significant environmental impacts to be expected.
      • Statements on the surrounding legally protected biotopes (§ 30 biotopes)
      • Impairment of compensation areas
    • Statements from BUND regional and district association and NABU regarding the meadow bird and breeding bird area in the district of Grafschaft Bentheim, the stepping stone function, resting bird mapping, bat mapping, amphibian mapping, floodplain, impact on compensation areas of the nature conservation foundation and biotopes protected under Section 30 and avoidance and compensation measures as well as CEF measures.
    • Statement and information from the AKFW (Arbeitskreis Feuchtwiesenschutz Westniedersachsen e. V.) regarding the Alte Piccardie meadow bird area and important traditional breeding area.
    • Statements on the floodplain and nature conservation.

The draft plan and annexes will be published on the Internet from 26 May 2025 to 27 June 2025 inclusive in accordance with Section 3 (2) of the German Building Code (BauGB) at www.neuenhaus.de under Citizens / Construction, Order, Transport / Urban land-use planning / Current planning procedures. In addition, the draft plan and annexes are available for public inspection during office hours at the town hall of the Neuenhaus joint municipality, Veldhausener Str. 26, 49828 Neuenhaus, in the citizens' office. There is a general opportunity for comments and discussion during the publication period. Comments can be submitted by email(rathaus@neuenhaus.de), by post (address above), fax (05941/911-260) or for recording.

Comments that are not submitted on time may be disregarded in the resolution on the urban land-use plan. An association within the meaning of Section 4 para. 3 sentence 1 no. 2 of the German Environmental Appeals Act (UmwRG) is excluded in an appeal procedure pursuant to Section 7 para. 2 of the UmwRG in accordance with Section 7 para. 3 sentence 1 of the UmwRG with all objections that it did not assert or did not assert in good time within the publication period but could have asserted.
